Terms of Service

1. Agreement

By accessing or using any Alvin Media website, product, or service (collectively, the "Services"), you agree to these Terms of Service. If you do not agree, do not use the Services. The Services are operated by Alvin Media LLC, a Colorado limited liability company.

2. The Services

Alvin Media provides: (a) digital products including AI playbooks ("Playbooks"); (b) hosted personal AI agent services ("Allies") — dedicated, single-tenant AI agent instances operated on your behalf; (c) educational content; and (d) customer account portals.

3. Accounts

• Accounts are authenticated by email magic link. You are responsible for access to your email account.
• You must be 18 or older to create an account or make a purchase.
• One account per person; account sharing is not permitted.
• We may suspend accounts that violate these Terms or the Acceptable Use Policy.

4. Purchases and Payment

• Prices are listed at checkout and processed by Stripe. Applicable sales tax is calculated and collected at checkout where required.
• Playbooks and digital products are governed by our Refund Policy.
• Allies: setup fees and subscription terms are as stated at checkout. Subscriptions renew until canceled. Cancellation stops future charges; access continues through the paid period.
• We may change prices with notice before your next billing cycle.

5. Your Ally

• An Ally acts on your behalf and at your direction. You are responsible for the instructions you give it and for reviewing its outputs before relying on them.
• Your Ally runs on dedicated infrastructure provisioned for you. We operate and maintain that infrastructure as part of the service.
• We do not access your Ally's memory or workspace except to provide support you request, to maintain the service, or as required by law.
• Allies require a third-party AI provider API key (e.g., DeepSeek, OpenAI) that you supply. Your use of that provider is governed by its terms and billed by that provider.

6. Acceptable Use

Your use of the Services is subject to our Acceptable Use Policy, incorporated by reference. Violations may result in suspension or termination.

7. Intellectual Property

• Playbooks are licensed, not sold: purchase grants you a non-exclusive, non-transferable license for personal use. Do not redistribute, resell, or publish Playbook content.
• Your data, your Ally's configuration, and content your Ally creates for you remain yours.
• Alvin Media retains all rights in the Services, brand, and platform.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. AI-GENERATED OUTPUT MAY BE WRONG, INCOMPLETE, OR UNSUITABLE — SEE OUR AI DISCLAIMER, INCORPORATED BY REFERENCE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALVIN MEDIA'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ACTIONS AN ALLY TAKES AT YOUR DIRECTION.

10. Dispute Resolution — Arbitration and Class-Action Waiver

Any dispute arising from these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court. You and Alvin Media each waive the right to a jury trial and to participate in a class action or class-wide arbitration. You may opt out of arbitration by written notice within 30 days of first accepting these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Subject to Section 10, exclusive venue is the state and federal courts located in Colorado.

12. General

• We may update these Terms with notice by email or in-product message. Continued use after the effective date constitutes acceptance.
• If any provision is unenforceable, the remainder survives.
• These Terms, together with the Privacy Policy, Refund Policy, AI Disclaimer, and Acceptable Use Policy, are the entire agreement.
